Florida foreclosure mediation is a process that involves the negotiation of the terms of a mortgage between the borrower and the lender. This program was set in place to prevent the occurrence of foreclosures as a result of failed communication between homeowners and lenders. The mediation allows both parties to present their arguments in front of a neutral court appointed party in order to gain control over the defaulted mortgage. This is an excellent resource for people that are apprehensive about contacting their lenders due to the mortgage delinquency.

There are requirements in order to participate in this Florida foreclosure mediation. Individuals that are seeking mediation must have a HUD approved housing or mortgage counselor. Likewise, the mediation has to be scheduled within 120 days of the filing of the foreclosure. Also, the lender is required to pay the mediation fee which can be reclaimed if the mediation process is not successful. In order for a delinquent mortgage to be eligible for foreclosure mediation the mortgage in question has to be the primary residence of the individual. The defaulted loan must also have originated under the federal truth-in-lending regulations.

Florida foreclosure mediation is an option for anyone that is currently behind on their mortgage. This is a way in which people may be able to save their homes from foreclosure by officially discussing the terms of the mortgage in the presence of a neutral party and hopefully coming to a conclusion that will be beneficial for all.
